VAWA Housing Rights
Protections for survivors of domestic violence, dating violence, sexual assault, and stalking.
The Violence Against Women Act (VAWA) provides important housing protections for survivors of domestic violence, dating violence, sexual assault, and stalking. These protections apply to residents and applicants of all genders in most federally assisted housing, including HUD-subsidized properties and communities financed through the Low-Income Housing Tax Credit (LIHTC) program — many of which Elite Property Management proudly manages across metro Detroit.
You cannot be denied or evicted because you are a survivor
You may not be denied admission to, denied assistance under, or evicted from housing simply because you are or have been a victim of domestic violence, dating violence, sexual assault, or stalking. An incident of abuse cannot be treated as a lease violation committed by the survivor, and criminal activity directly related to abuse cannot be cause to terminate the tenancy of the victim.
Confidentiality
Any information you provide about your situation is kept strictly confidential. Elite will not enter this information into any shared database or share it with anyone unless you give written permission, the law requires it, or it is needed for an eviction-related legal proceeding.
Emergency transfers
If you are a survivor and you reasonably believe you are threatened with imminent harm from further violence if you remain in your unit, you may be eligible for an emergency transfer to another safe and available unit. Talk with your community manager or our main office to begin the process.
Certification
When you seek VAWA protections, we may ask you to certify that you are a survivor. You can do this using HUD Form 5382 (Certification of Domestic Violence, Dating Violence, Sexual Assault, or Stalking), a similar document, a statement from a professional such as a victim service provider, attorney, or medical professional, or a police or court record. You will be given at least 14 business days to provide this documentation.
